1. About these Terms
These Terms & Conditions (“Terms”) govern your access to and use of the Toothpick website, mobile application and marketplace services.
By creating an account or using the Services, you agree to these Terms.
If you are using Toothpick on behalf of a dental practice, company or other organisation, you confirm that you have authority to accept these Terms on its behalf.
2. About Toothpick
Toothpick operates a digital marketplace connecting dental professionals, dental practices and authorised healthcare organisations with independent dental suppliers.
The Services may allow users to:
- Search and discover products
- Compare products and supplier offers
- Place orders
- Communicate with suppliers
- Make or facilitate payments
- Track orders
- Request support
- Manage purchasing activity
Unless expressly stated otherwise, Toothpick is not the seller, manufacturer, importer or distributor of the products listed by independent suppliers. The relevant supplier is responsible for the products it offers and supplies through the marketplace.
This marketplace structure is consistent with the supplier-based model reflected in Toothpick’s existing Terms, where the distributor/supplier is the merchant responsible for the relevant goods.
3. Eligibility
To use Toothpick, you must:
- Be a dental professional, dental practice or authorised healthcare organisation
- Provide accurate registration information
- Use the Services for legitimate professional dental purchasing purposes
- Comply with applicable laws and regulations
Where applicable, dentists may be required to provide a valid GDC registration number. Toothpick may verify information provided during registration.
4. Your Account
You are responsible for:
- Maintaining accurate account information
- Keeping your login credentials secure
- All activity carried out through your account
- Not allowing unauthorised persons to use your account
You must notify Toothpick if you believe your account has been compromised.
Toothpick may suspend or restrict an account where:
- Information cannot be verified
- The account is used improperly
- There is suspected fraud or misuse
- The user breaches these Terms
- Suspension is required by law or for security reasons
5. Products and Suppliers
Products displayed on Toothpick are supplied by independent suppliers. Suppliers are responsible for:
- Product descriptions
- Product availability
- Product pricing
- Product quality
- Product authenticity
- Regulatory compliance
- Packaging
- Fulfilment
- Delivery
- Warranties where applicable
- Returns
- Refunds
- Product recalls
Toothpick may support marketplace quality and information standards but does not guarantee the accuracy or completeness of supplier-provided information.
6. Product Information and Pricing
Toothpick aims to display accurate product information and pricing. However, supplier information may occasionally contain errors, outdated information, pricing errors, availability errors, or product description errors.
Where an error is identified, Toothpick or the relevant supplier may correct the information and, where appropriate, cancel or amend an affected order. Where an order is affected, the customer will be informed as reasonably practicable.
7. Orders
When you place an order, you are requesting to purchase products from the selected supplier. The relevant supplier is responsible for accepting and fulfilling the order.
An order may be cancelled or amended where permitted or required due to:
- Product unavailability
- Pricing errors
- Supplier restrictions
- Regulatory requirements
- Product restrictions
- Other legitimate operational circumstances
Where an order contains products from multiple suppliers, the order may be fulfilled as separate supplier orders and may be subject to separate delivery arrangements and applicable charges.
8. Payments
Payments may be processed through third-party payment providers. By placing an order, you authorise the applicable payment processing.
Toothpick may facilitate payment collection and settlement between customers and suppliers, depending on the applicable payment structure. Payment processing is subject to the terms and policies of the relevant payment provider.
Where financing or payment plans are available, they may be offered by independent financial providers and are subject to separate eligibility requirements and agreements.
9. Delivery
Unless expressly stated otherwise, delivery is arranged and fulfilled by the relevant supplier or its appointed delivery provider. The supplier is responsible for:
- Dispatch
- Delivery arrangements
- Delivery tracking
- Delivery issues
- Delivery-related communication
Any delivery estimates displayed through Toothpick are estimates and may change. Where a delivery issue occurs, customers should report it through Toothpick so that Toothpick can assist in communicating with the relevant supplier.
10. Returns and Refunds
Returns and refunds are governed by applicable UK law and the relevant supplier’s applicable policies. The applicable return policy may vary depending on:
- Supplier
- Product
- Product condition
- Whether the product has been opened or used
- Whether the product is sterile
- Whether the product is customised
- Applicable healthcare or regulatory requirements

11. Damaged or Incorrect Products
If you receive a damaged, defective or incorrect product, you should report the issue as soon as reasonably possible. Where appropriate:
- Keep the product
- Keep the original packaging
- Do not dispose of the product before the issue has been reviewed
- Provide photographs or other requested evidence
- Follow the supplier’s instructions
Toothpick may assist in coordinating communication between the customer and supplier. The supplier remains responsible for handling the product-related claim in accordance with applicable law and its applicable policies.
12. Customer Responsibilities
You agree to:
- Provide accurate delivery and account information
- Use products only for legitimate professional purposes
- Follow applicable product instructions
- Comply with applicable laws and regulations
- Inspect deliveries where reasonably possible
- Report issues promptly
- Not misuse the platform
13. Acceptable Use
You must not:
- Use Toothpick unlawfully
- Attempt to gain unauthorised access to the platform
- Interfere with the operation of the Services
- Scrape or systematically extract marketplace data without permission
- Upload malicious content
- Use another person’s account without authorisation
- Submit fraudulent orders
- Abuse promotions or payment systems
Toothpick may restrict or terminate access where misuse is identified.
14. Intellectual Property
Toothpick and its licensors retain all rights in the Toothpick platform, software, branding, content, design and related intellectual property.
You may use the Services only for their intended purpose. You must not copy, reproduce, modify, distribute, sell or commercially exploit Toothpick’s platform or content without written permission.
15. Third-Party Services
Toothpick may integrate with third-party services including:
- Payment providers
- Delivery providers
- Verification providers
- Technology providers
- Analytics providers
Third-party services may be subject to their own terms and policies.
16. Availability of the Services
Toothpick will seek to maintain the availability and functionality of the platform but does not guarantee that the Services will always be available, uninterrupted, error-free, or free from technical issues.
Toothpick may modify, suspend or discontinue features as required to operate and improve the Services.
17. Complaints and Support

- Delivery issue: contact the supplier through Toothpick.
- Payment or platform issue: contact Toothpick Support at [email protected].
Toothpick may assist in coordinating communication but does not replace the supplier’s responsibility for supplier-provided products and services.
18. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful under UK law.
Subject to the above, Toothpick is not responsible for matters that are the responsibility of independent suppliers, including product quality, product compliance, fulfilment, supplier delivery arrangements, supplier warranties, returns or refunds.
Nothing in these Terms affects statutory rights that cannot legally be excluded or limited.
19. Indemnification
To the extent permitted by applicable law, you may be responsible for losses or costs arising from your unlawful use of the Services or material breach of these Terms.
20. Suspension and Termination
You may stop using Toothpick at any time.
Toothpick may suspend or terminate access where:
- These Terms are breached
- Fraud or misuse is suspected
- Professional eligibility cannot be verified
- Continued access creates a security, legal or regulatory concern
- Required by law
Any rights or obligations that are intended to survive termination will continue to apply.
21. Changes to these Terms
Toothpick may update these Terms from time to time. Where changes are material, Toothpick will provide appropriate notice. The latest version will be made available through the Services.
22. Governing Law
These Terms shall be governed by the laws of England and Wales, subject to any mandatory consumer or other statutory rights that apply.
